Builderall Referral Program
Terms & Conditions of Use

1. About the Program
 
The Builderall Referral Program (“Program”) is designed to help individuals and organizations (“Referrers”) grow their businesses while promoting the Builderall platform. Referrers may earn commissions based on their referrals and gain access to resources, tools, and opportunities to collaborate within the Builderall community.
 
Participation in the Program is a voluntary business relationship. It does not create an employment relationship, partnership, or joint venture with Builderall.
 
 
2. Referral member Responsibilities
 
2.1 Truthful Representation
 Referral members must provide accurate and up-to-date information when promoting the Builderall platform. Features, pricing, and terms may change without notice, and it is the Referrer’s responsibility to ensure their promotions remain current.
 
2.2 Mandatory Disclaimers
 When promoting the Program, Referrers must clearly disclose that results vary by individual effort and no income is guaranteed. Misleading statements such as “make $2,000 easily” must be reworded to personal statements like “How I made $2,000 with Builderall.”

2.3 Ethical Promotion
 Referrers may not:
 
  • Offer monetary bonuses or incentives for joining Builderall
     
  • Use luxury lifestyles, cars, or high incomes as typical outcomes
     
  • Show exact earnings figures or residual income amounts without a disclaimer
     
  • Promise bonuses, training, or support that they cannot deliver
     
2.4 Respect for Other Referrers
 Referrers must not:
 
  • Poach leads already assigned to another Referrer
     
  • Place referral links in another Partner’s ads, posts, or webinars
     
  • Attempt to manipulate referral attribution to claim a lead that belongs to another Referrer
     
  • Engage in unethical practices that damage another Referrer’s efforts
     
2.5 Professional Conduct
 Referrers must treat Builderall staff and other Referrers with respect. Harassment, abusive language, or unethical behavior may result in immediate removal from the Program.
 
2.6 Compliance with Laws
 Referrers are responsible for ensuring their promotional activities comply with all applicable laws, including advertising, data protection, and consumer protection regulations.
 
 
3. Compensation
 
3.1 Commission Structure
 Referral members earn a one-time 50% commission on every Builderall plan sold.
 
 Commissions are contingent on the referred subscription remaining active and can be changed or revoked accordingly to company discretion.
 
3.2 Processing Fees
 A 10% payment method processing fee applies to all commission payouts. An additional 10% administrative fee may be assessed depending on Referrer status.
 
3.3 Fraud Disputes
 If a referred sale is reported as fraudulent, the COMPANY may deduct a $15 USD chargeback fee from the Referrer’s available commissions. Excessive fraud disputes may lead to termination.
 
3.4 Withdrawal Thresholds
 Referrers must have a minimum of $100 (or €100) available to request a withdrawal.

3.5 Local Currency Restrictions
 Referrers wishing to earn commissions in Brazilian Reais (BRL) must be legal residents of Brazil.
 

4. Prohibited Practices

4.1 Promotional Misconduct
 Referrers may not:
 
  • Bid on “Builderall” or any variation/misspelling of the trademark in paid ads
     
  • Own or operate more than one Referrer account
     
  • Use Builderall branding in a way that misleads users into believing they are interacting directly with Builderall rather than an independent Referrer
     
  • Use Builderall’s corporate contact details (email, phone, address) on personal promotional sites
     
  • Send unsolicited or repetitive messages (SPAM)
     
  • Use negative marketing such as “Builderall is a scam” to generate leads
     
4.2 Lead Manipulation
 Transferring or reassigning leads between Referrers is not permitted. Fraudulent migrations, duplicate accounts, or any attempt to improperly claim a lead that belongs to another Referral member is strictly prohibited.
 
4.3 Referral Attribution
 To ensure correct referral attribution, Referrers should verify that the referred user is registering without conflicting cookies or prior sessions with another Referrer’s link.
 
 
5. Company Rights
 
5.1 Right to Modify or Terminate
 CloudBuilder LLC (“COMPANY”) reserves the right to:
 
  • Update or modify these Terms, Program requirements, or commission structures at any time
     
  • Review Referrer accounts quarterly to assess promotional activity and performance. All evaluations are at Builderall’s sole discretion.
     
  • Review and terminate accounts that are inactive, non-compliant, or otherwise deemed not a fit for the Program
     
  • Suspend or revoke participation without prior notice if necessary to protect the COMPANY’s business or brand
     
Participation in the Program is not guaranteed or permanent. Continued participation after any updates constitutes acceptance of the revised Terms.
 
5.2 No Income Guarantee
 Results may vary based on individual effort. The COMPANY makes no guarantee of income or business success.
 
5.3 Tax Obligations
 Referrers are solely responsible for all applicable taxes (withholding, sales, VAT, GST, etc.) and agree to indemnify the COMPANY for any resulting claims.
 
 
6. Legal Provisions
 
6.1 Indemnification
 Referrers agree to indemnify and hold the COMPANY harmless from any claims, liabilities, or costs resulting from their participation in or promotion of the Program.
 
6.2 Governing Law & Jurisdiction
 These Terms are governed by the laws of the State of Florida, USA. Any disputes will be resolved exclusively in the courts of Miami-Dade County, Florida.
 
6.3 Entire Agreement
 These Terms supersede any prior agreements or representations, written or oral, regarding the Referral Program.
 
 
7. General Policies
 
7.1 Re-Registration Policy
 If a user has deleted or canceled their account, they may register again after a 6-month waiting period, even if referred by a different Referrer. However, no prior data, files, or websites will be restored.
 
7.2 One Account Policy
 Each individual or organization may maintain only one Referrer account. Creating duplicate accounts for the purpose of generating additional commissions is prohibited.
 
7.3 Referral Visibility
 Referrers will only be able to view the registered Builderall email address of their direct referrals. Referral members cannot view or access referral information beyond their own direct leads.
 
 
8. General Disclaimers
 
  • Participation in the Program does not establish an employment, agency, or joint venture relationship with the COMPANY.
     
  • Features, services, and commission structures may change without notice.
     
  • The COMPANY may withhold or adjust commissions in cases of fraud, chargebacks, or violations.
